What happened
New York state has filed a lawsuit against Kalshi, accusing the prediction market of running an illegal gambling operation. The suit claims Kalshi operates without a state gaming license, fails to pay required taxes, and allows users as young as 18 to bet on sports, in violation of New York's minimum age of 21.
Why it matters for the market
Governor Kathy Hochul said the company has ignored state gaming laws designed to protect consumers and prevent problem gambling. Attorney General Letitia James called prediction markets like Kalshi gambling platforms, plain and simple. The state is seeking a court order to block Kalshi from operating without a license, along with restitution, forfeiture of gains, and fines.
Kalshi responded by dismissing the lawsuit as political theater. A company spokesperson said states cannot shut down a federally licensed exchange and warned that New Yorkers would be driven to offshore platforms if the platform were blocked.
What traders should watch
The dispute is part of a broader clash between New York and federally regulated trading venues. CFTC Chair Mike Selig has argued prediction markets are not state gambling operations and previously sued New York in April after the state moved against Coinbase and Gemini. The CFTC has also requested a temporary restraining order to stop what it calls aggressive state efforts to regulate prediction markets.
